Grant Brian Peixoto a new trial to prove his innocence

Dear Friends,
We ask for your support of our petition on Change.org in which we are requesting an opportunity to present newly discovered medical evidence in order to prove Brian's innocence. This evidence is offered by four well known and highly respected medical professionals whose specialties include: clinical pathology, pediatric neuropathology, forensic pathology/ME and biomechanical/biomedical engineering.

Brian Peixoto has spent the last 18 years in prison for a murder he did not commit. There was no physical evidence linking Brian to the death. He was convicted based on faulty medical science offered by unqualified doctors. His conviction was also based on one of the many versions of events offered by Ami Sneed, the child's mother who, in order to avoid prosecution herself did offer to change her story as needed. Brian has consistently maintained his innocence. His version of events never changed, from the first time he was interviewed by police in 1996 until today.

Signed. The evidence used against Brian in this case looks extremely dubious. It seems to be a classic case of the investigators marking their man and twisting the evidence to fit it.

There was absolutely no evidence pointing to Brian. X-rays reportedly taken in the ER post-mortem were never turned over to the defense. Also, the ME testified that he was unaware of the prior fall and also had not seen any x-rays from the ER. Police presence outnumber medical staff 2:1 at the autopsy. Objectivity of the ME is something that has been scrutinized in many wrongful conviction cases. While particulars in each case will vary, the charged emotions inevitably triggered by a child's death add another layer of complexity. Forensic pathologists can get caught up in the anger, emotion and outrage and easily lose sight of objectivity. Their mindset can become prosecutorial, and, consequently, child deaths become a homicide until proven otherwise.
